Qualifying Conditions for Medical Marijuana in New Mexico

There are now 28 qualifying conditions for the medical cannabis program in New Mexico, (revised 6/2019*). Check back frequently, as new conditions are added as presented by the NM Medical Cannabis Advisory Board and approved by the NM Secretary of Health. This list started out with only 7 qualifying conditions back in 2007, and although this list should include ANY condition for which a doctor believes marijuana would be a benefit to their patient, we are grateful for what we have.

The qualifying conditions to become a Medical Cannabis user in our State of New Mexico are as follows:

  • Alzheimer’s Disease
  • Amyotrophic Lateral Sclerosis (ALS, Lou Gehrig’s Disease)
  • Autism Spectrum Disorder
  • Cancer (must specify what type)
  • Crohn’s Disease
  • Epilepsy
  • Friedreich’s Ataxia
  • Glaucoma
  • HIV/AIDS
  • Hepatitis C (infection currently receiving antiviral treatment)
  • Hospice Care
  • Huntington’s Disease
  • Inclusion Body Myositis
  • Inflammatory Autoimmune-mediated Arthritis
  • Intractable Nausea/Vomiting
  • Lewy Body Disease
  • Multiple Sclerosis
  • Obstructive Sleep Apnea
  • Opioid Use Disorder
  • Painful Peripheral Neuropathy
  • Parkinson’s Disease
  • Post-Traumatic Stress Disorder
  • Severe Chronic Pain
  • Severe Anorexia/Cachexia
  • Spasmodic Torticollis (Cervical Dystonia)
  • Spinal Cord Damage with Intractable Spasticity (proof of objective neurological indication of intractable spasticity required)
  • Spinal Muscular Atrophy
  • Ulcerative Colitis

*Obstructive Sleep Apnea was approved as a Qualifying Condition in late September, 2018. This was the first addition to the list since 2015. In June, 2019 the Department of Health announced that the new Secretary of Health has accepted several qualifying conditions that had bee recommended by the Medical Advisory Board over the last several years but were rejected by the Secretary action under the Susana Martinez administration.

    1. Hi John. You can apply for a card as soon as you have a NM ID ie: Drivers License. Please check the NM MVD sight to be sure you have everything you need to get your driver’s lic, as it has become really convoluted. You will also need your medical records 12 months old or less. Then you will have take these items to a medical cannabis doctor. I suggest 420 Connect…and you should also contact them before you get here to be sure this info I am giving you is the most current. (Things change often here.) Once you send in your application, (which the Medical Cannabis doc will provide to you), it takes about 30 days to get your card.

  1. I got shot in the ankle back in high school and now I’m 42 and I have pretty bad arthritis from it but the hospital doesn’t have any more records from back that far what do I do and am I eligible for the medical marijuana program

    1. Hi Richard, The Department of Health requires that you have been seen for your condition by a doctor in the last 12 months, so those records wouldn’t have worked anyway. Any Nurse Practitioner, Physicians Assistant or doctor will do, and you may even find one that will fill out the (Doctor part) paperwork for you. If not, you will need to take the records from your visit to the healthcare practitioner to a medical cannabis qualifying doctor and they will fill out the paperwork for a fee. I suggest using 420 Connect, 505-850-4849.

  2. I just recently moved to El Paso and have an authorization form for purchasing medical marijuana. Would it be possible to purchase medical marijuana with this authorization. Please advise.

    1. I am unfamiliar with the authorization form or any of the rules in TX. In NM you must have a health care professional fill out the forms for the NM Medical Cannabis program and submit them, get approval from the Department of Health’s MC program and wait for them to send you the card to be a patient.

  5. I was diagnosed with cancer in 2005 when i was 7. I underwent spinal taps for 2 years and this has caused me to have bad back pain. It was really hard not only during treatment but after. This has caused me to not like being around alot of people expecially if they looking at me. And i am uncomfortable around strangers. I was diagnosed with mild sleep apnea early 2017 i think. I am a “A” and “B” college student. I have been recently diagnosed with generalized anxiety disorder. Something small could happen and then everything after that just to seem like everything gets worse and i have a emotional breakdown and its hard for me to calm down. When i smoke weed it helps me calm down faster and it helps me think clearer. It also helps me with my back pain and it usually goes away for several hours.

    1. Sorry. It also helps me sleep. But My question was will i qualify for a medical card and will it affect the scholarships i receive through school if i do get a medical card?

      1. That is a question for a lawyer. Sorry. But yes, you qualify for the NM Medical Cannabis program under sever chronic pain. Here is a list of qualifying conditions. Also…all patients in the program are protected HIPAA and their names are only checked by law enforcement as “yes, part of the program, or yes, able to grow”. They cannot get a list of participating patients. If you are drug tested for a job you are not protected at this time if you test positive for THC and that isn’t okay with your employer.

  6. Hi, I have cronic back pain and severe anxiety. My doctor prescribes me pain killers and xanax for the anxiety. I was wondering if i would qualify, and if so how do i go about doing it?

  7. I have a severe anxiety disorder somtimes I get really bad panic attacks and I’m always stressed out and I always live in fear can’t never catch a break will I be able to qualify here in new mexico

    1. I have spoken with several RNs in our state and as far as the Nursing Board is concerned being a medical cannabis patient in NM is NOT grounds to loose your license. I do suggest you call the Nursing board directly and ask to be sure. I know many outspoken nurses and nurse practitioners who are registered in this program.

I have seasonal affective disorder which leaves me with really bad and painful migraines, headaches, body pains, and an overall lack of energy. This happens whenever it is very gloomy outside for me and I dont know how else to treat it. Thank you so much for your time!

  9. I had hodgkins disease 30 years ago, but the anxiety of it coming back is always there. Since I am in remission, can a Doctor still qualify me to get a card. I want to do the whole Rick Simpson Oil protocal and then go on a maintence dose forever. So before I spend a lot of money on submitting records and etc., I would like to know my chances.     1. Hi Joe. I am relatively sure that if your cancer has been in remission for 30 years you will not qualify in the NM MCP for cancer. However, you may qualify under another condition, depending on a few things. Your anxiety may be PTSD, or you may suffer from some kind of chronic pain. The reason that the numbers of patients in NM for these two conditions is so high is because many people, like myself, have multiple conditions and these two are common to more people than any other conditions. Either of this places can give you a firm answer and/or tell you what you need to do and if you qualify.

  10. I am looking into getting my card. I was born with seizures and still continue to have them. Since a seizure has not been re order during my EEG my Dr has not been able to diagnose,me with epilepsy. Can I still be approved ? I also have been diagnosed with insomnia and anxiety.
